Unauthorized Construction Rising at Alberta Livestock Operations

Unauthorized construction at Alberta confined feeding operations is increasing, according to the Natural Resources Conservation Board (NRCB).

The NRCB reports that complaints related to unauthorized construction rose by about 32 per cent in 2024. During the same period, enforcement actions increased by roughly 125 per cent. Officials say the trend raises concerns as construction activity continues across beef and dairy operations.

Alberta’s Agricultural Operation Practices Act (AOPA) requires producers to obtain NRCB approval before starting construction. This requirement applies to confined feeding operations and related infrastructure.

Permit approval is required before building manure storage facilities, including earthen manure storages and lagoons. It also applies to manure collection areas such as barn floors, feedlot pens and catch basins.

Producers who begin construction before receiving approval are in violation of the Act. Building something that differs from what the permit allows is also considered unauthorized construction.

The NRCB says constructing without a permit is a serious offence. Consequences may include enforcement orders or prosecution. In some cases, producers may face added costs, such as removing livestock from facilities built without approval.

Unauthorized construction can also affect financing. Financial institutions increasingly require proof of NRCB compliance before approving loans. Producers who start building without a permit may face delays or financing denials.
