Terry Maul, the former CEO of STX Beef, has filed a motion to dismiss several counts in a lawsuit that accuses him and former CFO William Fischer of embezzling more than $2 million from the company. Maul’s motion seeks to remove Counts 3-7, which include allegations of common law fraud, fraud by nondisclosure, and civil conspiracy. He also challenges a breach of contract claim related to his 2019 employment agreement, citing insufficient evidence and procedural missteps by STX.
STX claims Maul and Fischer received unauthorized payments during their oversight of the company’s executive payroll. However, Maul’s legal team argues that the fraud accusations are vague and fail to meet federal legal standards. The court has not yet issued a ruling on the motion.
Fischer was terminated in December, and Maul resigned in January, following the initiation of the lawsuit.
